LearnPoems EULA / Terms of Service

1. Acceptance

By installing, downloading, or using the LearnPoems application (Учи стихи, the "App"), you agree to this End-User Licence Agreement ("EULA") between you and Kiryl Anokhin, JDG (Poland), NIP 8982272619, REGON 521004109, address ul. Chorwacka 41B-13, Wrocław, Poland (the "Operator").

Current version: v1.2, effective 30 September 2026.

2. The service

The App is a trainer for learning poems by heart. You can add poems from the poets.by catalogue or enter your own texts, work through reading, gap-filling and recall stages, record your own reading, schedule review reminders and, once a poem is learned, record yourself reciting it by heart. Catalogue poems, narration audio and short analyses are provided as public literary content for personal, non-commercial use. There are no user accounts. Everything you enter, learn or record stays on your device. The one exception is a recital you deliberately choose to share as a link (section 9); nothing else can be published from the App.

3. Licence

The Operator grants you a personal, non-transferable, revocable, non-exclusive licence to install and use the App on devices you own or control, subject to the App Store / Google Play rules.

4. Apple Licensed Application EULA

For App Store users: this EULA supplements Apple's standard Licensed Application EULA. In case of conflict, Apple's terms prevail. Apple is not a party to this EULA but is a third-party beneficiary that may rely on it.

5. Google Play terms

For Google Play users: this EULA is subject to the Google Play policies. In case of conflict, the Google Play policies prevail.

6. Advertising and monetisation

The App is free and is supported by advertising. The App contains no in-app purchases and no subscriptions.

  • Ads are served through Google AdMob as banner and interstitial ads.
  • Where required by your region, the App shows a consent request (Google UMP / GDPR) before serving ads. Your choice can be changed later in Settings.
  • On iOS, the App requests App Tracking Transparency (ATT) consent before allowing personalised ads. If you decline, AdMob will serve non-personalised ads only; the App's core functionality is unchanged.
  • On Android, advertising uses the Google Advertising ID (GAID) according to your device settings. You can reset the advertising ID or opt out of personalisation in your Android settings.
  • Ads are supplied by third parties through AdMob. The Operator does not control, endorse, or take responsibility for the content of third-party ads or any sites or offers they link to.
  • AdMob's data practices are described in Google's privacy policy.

7. Permissions

The App may request:

  • Microphone — to record your own reading of a poem, and later your recital by heart, when you tap a record button. Recordings are stored on your device and are uploaded only if you choose to share a recital (section 9);
  • Notifications — to deliver the review reminders you schedule, which are set locally on your device;
  • App Tracking Transparency (iOS) — used solely to determine whether AdMob may serve personalised ads. You may decline.

Declining microphone access or notifications does not block core functionality. Declining ATT only switches ads to non-personalised mode.

8. Intellectual property

Poems, narration audio and analyses from the catalogue are works of their respective authors and rights holders and are provided for personal learning only. You may not redistribute this content commercially or present it as your own.

Texts you enter yourself remain yours. They are stored only on your device and the Operator makes no claim to them. You are responsible for having the right to use any text you enter.

The App, its design, and its software are protected by intellectual-property law.

9. Shared recitals

Sharing a recital is optional. When you tap Upload and get a link, the App uploads that recording to poets.by, where it gets an unlisted page: anyone who has the link can listen to it, and the page is marked not to be indexed by search engines. The page shows the poem (for catalogue poems), the author, the date and your dedication, and nothing about you.

  • Your recording stays yours. You keep all rights to it. So that the page can work, you grant the Operator a non-exclusive, worldwide, royalty-free licence to store, re-encode, stream and display the recording and the dedication on that page for as long as it is shared. The licence ends when sharing ends.
  • What you confirm by uploading: the recording is of your own voice; for a text you entered yourself, you have the right to recite it and to have its title and author line shown; the dedication is one line, contains no links, e-mail addresses or phone numbers, no personal data of other people, and nothing unlawful, offensive or misleading.
  • Withdrawal. You can withdraw a shared recital at any time from the App with Stop sharing or by deleting the recording, and you can replace the audio by re-recording. If you no longer have the App or the phone, write to [email protected] with the link and it will be removed. When sharing ends, the Operator deletes the recording and the page.
  • Moderation. Listeners can report a recital. One reported by three different people is hidden automatically until reviewed. The Operator may hide or remove any recital after a report, on a rights holder's request, or at its own discretion, without notice.
  • Availability. Shared pages are provided as they are, with no promise of uptime or of how long a link keeps working. Keep your own copy of a recording you care about.

10. Acceptable use

You must not:

  • decompile, disassemble, or modify the App except where the law expressly permits;
  • bypass technical protection measures;
  • use the App for unlawful activity;
  • interfere with the display of, or attempt to manipulate, in-app advertising (for example, by automated clicking or by injecting third-party software);
  • share recordings that are not your own voice, that contain other people's personal data, or that are unlawful, offensive or misleading, or use the dedication for advertising or contact details.

11. Disclaimer and limitation of liability

The App is provided "as is". The Operator does not warrant that it will fit your particular purposes or operate uninterrupted or error-free, and does not guarantee any learning outcome. The Operator is not responsible for the content, accuracy, or availability of third-party advertisements served through AdMob, or for any goods or services obtained through them. Local data, including recordings, may be lost if the device fails or the App is uninstalled; the Operator holds no copy other than a recital you have shared, and only while it is shared. To the maximum extent permitted by law, the Operator is not liable for indirect damages. Mandatory consumer rights (EU, Poland) are preserved.

12. Governing law

This EULA is governed by the law of Poland. For EU consumers, the mandatory consumer-protection rules of their country of residence are preserved (Rome I Regulation). Claims related to the App brought against Apple or Google are governed by their respective terms.

13. Termination

The licence terminates automatically on any breach of this EULA. You may terminate it at any time by uninstalling the App. Recitals you have shared stay online until withdrawn (section 9).

14. Changes

We may update this EULA from time to time. The current version is published at poets.by/learnpoems/en/terms and is bundled with each App release.
