Poems by Mood EULA / Terms of Service

1. Acceptance

By installing, downloading, or using the Poems by Mood application (Стихи под настроение, the "App"), you agree to this End-User Licence Agreement ("EULA") between you and Kiryl Anokhin, JDG (Poland), NIP 8982272619, REGON 521004109, address ul. Chorwacka 41B-13, Wrocław, Poland (the "Operator").

Current version: v1.1, effective 15 October 2026.

2. The service

The App is a reading catalogue for discovering and reading poetry by mood, theme, author, and free-text prompt, with optional audio narration. With In your voice you can record your own reading of a poem and, if you choose, send it as a voice card — a link to a page on poets.by. Poems, narration and analyses are provided as public literary content for personal, non-commercial reading. There are no user accounts. Your recordings stay on your device. The one exception is a voice card you deliberately choose to create (section 9); nothing else can be published from the App.

3. Licence

The Operator grants you a personal, non-transferable, revocable, non-exclusive licence to install and use the App on devices you own or control, subject to the App Store / Google Play rules.

4. Apple Licensed Application EULA

For App Store users: this EULA supplements Apple's standard Licensed Application EULA. In case of conflict, Apple's terms prevail. Apple is not a party to this EULA but is a third-party beneficiary that may rely on it.

5. Google Play terms

For Google Play users: this EULA is subject to the Google Play policies. In case of conflict, the Google Play policies prevail.

6. Advertising and monetisation

The App is free and is supported by advertising. The App contains no in-app purchases and no subscriptions.

  • Ads are served through Google AdMob as native ads and interstitial ads.
  • Where required by your region, the App shows a consent request (Google UMP / GDPR) before serving ads.
  • On iOS, the App requests App Tracking Transparency (ATT) consent before allowing personalised ads. If you decline, AdMob will serve non-personalised ads only; the App's core functionality is unchanged.
  • On Android, advertising uses the Google Advertising ID (GAID) according to your device settings. You can reset the advertising ID or opt out of personalisation in your Android settings.
  • Ads are supplied by third parties through AdMob. The Operator does not control, endorse, or take responsibility for the content of third-party ads or any sites or offers they link to.
  • AdMob's data practices are described in Google's privacy policy.

7. Permissions

The App may request:

  • Microphone — to record your own reading of a poem in In your voice, when you tap the record button. Recordings are stored on your device and are uploaded only if you create a voice card (section 9);
  • Notifications — to deliver the optional daily "Poem of the day" reminder, scheduled locally on your device;
  • App Tracking Transparency (iOS) — used solely to determine whether AdMob may serve personalised ads. You may decline.

Declining microphone access or notifications does not block core functionality. Declining ATT only switches ads to non-personalised mode.

8. Intellectual property

Poems and related literary texts are works of their respective authors and rights holders and are provided for personal reading only. You may not redistribute this content commercially or present it as your own.

Your In your voice recordings remain yours (section 9).

The App, its design, and its software are protected by intellectual-property law.

9. Voice cards

Creating a voice card is optional. When you tap Create the card, the App uploads your recording to poets.by, where it gets an unlisted page: anyone who has the link can listen to it, and the page is marked not to be indexed by search engines. The page shows the poem, the author, the date, your dedication and your signature, and nothing about you beyond what you typed into those two fields.

  • Your recording stays yours. You keep all rights to it. So that the page can work, you grant the Operator a non-exclusive, worldwide, royalty-free licence to store, re-encode, stream and display the recording, the dedication and the signature on that page and in link previews of it, for as long as the card is shared. The licence ends when sharing ends.
  • What you confirm by uploading: the recording is of your own voice and of your own reading of a poem from the App's catalogue; you use the voice card only for personal, non-commercial purposes; you acquire no rights in the poem itself, and the Operator may remove the card at a rights holder's request (see Moderation below); the dedication and signature contain no links, e-mail addresses or phone numbers, no personal data of other people, and nothing unlawful, offensive or misleading.
  • Withdrawal. You can withdraw a voice card at any time from the App with Stop sharing or by deleting the recording, edit the dedication and signature from the same phone, and replace the audio by re-recording. If you no longer have the App or the phone, write to [email protected] with the link and the card will be removed. When sharing ends, the Operator deletes the recording and the page.
  • Moderation. Listeners can report a voice card. One reported by three different people is hidden automatically until reviewed. The Operator may hide or remove any card after a report, on a rights holder's request, or at its own discretion, without notice.
  • Availability. Voice-card pages are provided as they are, with no promise of uptime or of how long a link keeps working. Keep your own copy of a recording you care about.

10. Acceptable use

You must not:

  • decompile, disassemble, or modify the App except where the law expressly permits;
  • bypass technical protection measures;
  • use the App for unlawful activity;
  • interfere with the display of, or attempt to manipulate, in-app advertising (for example, by automated clicking or by injecting third-party software);
  • create voice cards with a recording that is not your own voice, that contain other people's personal data, or that are unlawful, offensive or misleading, or use the dedication or signature for advertising or contact details.

11. Disclaimer and limitation of liability

The App is provided "as is". The Operator does not warrant that it will fit your particular purposes or operate uninterrupted or error-free. The Operator is not responsible for the content, accuracy, or availability of third-party advertisements served through AdMob, or for any goods or services obtained through them. Local data, including In your voice recordings, may be lost if the device fails or the App is uninstalled; the Operator holds no copy other than a voice card you have created, and only while it is shared. To the maximum extent permitted by law, the Operator is not liable for indirect damages. Mandatory consumer rights (EU, Poland) are preserved.

12. Governing law

This EULA is governed by the law of Poland. For EU consumers, the mandatory consumer-protection rules of their country of residence are preserved (Rome I Regulation). Claims related to the App brought against Apple or Google are governed by their respective terms.

13. Termination

The licence terminates automatically on any breach of this EULA. You may terminate it at any time by uninstalling the App. Voice cards you have created stay online until withdrawn (section 9).

14. Changes

We may update this EULA from time to time. The current version is published at poets.by/poemsbymood/en/terms and is bundled with each App release.
