PoemShip Terms of Service
1. Parties and effective date
These Terms are a legal agreement between you ("User") and Kiryl Anokhin, JDG (Poland), NIP 8982272619, REGON 521004109, address Wrocław, Poland (the "Operator").
Current version: v1.2, effective 15 October 2026.
2. Service description
PoemShip is a curated online library of poetry for readers, and a place where authors keep their own poems. Library poems are chosen by the Operator. Members can keep poems in their account and, where the Service offers it, submit them to the library.
3. Eligibility
The Service is intended for users aged 13 and above. By using the Service you confirm that you have reached that age. If you are under 18, make sure you have your parent's or guardian's consent.
4. Account
Writing poems, comments or a profile requires an account with a confirmed email address. Until you confirm it, your account can read but not post. You are responsible for keeping your password secret and for all actions taken under your account. Report unauthorised access to [email protected].
You may delete your account at any time from settings — this is irreversible.
5. Your poems and other content
When you post poems, comments, a profile or other material ("Content"), you:
- Confirm that every poem you post is your own work, written by you as a person, and not generated or co-written by artificial intelligence; and that you have not granted anyone exclusive rights that would prevent you from posting it here.
- Agree not to post poems written by other people, even with credit.
- Grant the Operator a non-exclusive, worldwide, royalty-free licence to host, store and display the Content within the Service. The licence ends when you delete the Content or your account.
- Keep all rights to your works. We do not claim authorship of your texts, and you may publish them anywhere else.
Visibility:
- Unlisted (default): the poem is not part of the library, does not appear in public listings or search, and is excluded from search engines. Anyone who has its link can read it.
- Only me: the poem is visible only to you. We cannot guarantee confidentiality if you share the text yourself.
5a. Submitting a poem to the library
You may submit a poem you have posted on the Service for inclusion in the library. Submission is optional, and we decide which poems join the library. You confirm that you have not granted anyone exclusive rights to the poem. If we accept a poem:
- it becomes public: readers, search engines and our apps can find it;
- you grant the Operator a non-exclusive, worldwide, royalty-free licence to publish it on the Service and in our apps, next to advertising, and to create and publish summaries, analyses, tags, audio and other materials about it;
- no payment is due either way;
- you remain free to publish the poem anywhere else;
- you may withdraw the poem at any time; we remove it from the library immediately and remove the materials made for it within 30 days; the poem stays in your account as an Unlisted poem;
- if you edit an accepted poem, it leaves the library until we review it again.
6. Acceptable use
You agree not to:
- post poems you did not write yourself, or poems generated or co-written by artificial intelligence;
- post unlawful, defamatory, hateful, pornographic, or threatening content;
- infringe third-party intellectual property rights;
- use automated tools (scraping, bots) without permission;
- overload or damage the infrastructure.
Detailed community guidelines are at Rules.
7. Advertising
The Service may display advertisements (Google AdSense). Ad display depends on your consent choices in the cookie settings.
8. Operator intellectual property
Code, design, logo, database structure, and interface are the property of the Operator and protected by law.
AI-generated analyses, audio recordings, and video content produced by PoemShip are also the exclusive intellectual property of the Operator. Note: poem texts belong to their respective authors — the Operator makes no claim over them.
When reproducing or reposting any of the above materials you must:
- Link back to the original page on PoemShip where the material appears.
- Not use them for commercial purposes without prior written permission from the Operator.
Unauthorised commercial use is prohibited.
9. Removing a poem and copyright
If a poem on the Service was posted without your consent, infringes your copyright, or credits the wrong author, write to [email protected] as described in Removing a poem on the About page. A plain email is enough. We reply within a few days and, once confirmed, remove the poem or correct the credit.
10. Disclaimer of warranties
The Service is provided "as is". We do not warrant uninterrupted operation, the absence of errors, or preservation of all data in every situation. This does not limit mandatory consumer rights that cannot be excluded by law.
11. Limitation of liability
To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, special, or consequential damages. Mandatory consumer rights (Poland, EU) remain fully preserved.
12. Governing law
These Terms are governed by the law of Poland. For EU consumers, mandatory consumer protections of the country of residence are preserved (Rome I Regulation).
13. Disputes and ODR
We encourage resolving disputes by direct negotiation: [email protected]. EU consumers may also use the Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
14. Changes to the Terms
We may update these Terms. For material changes we will give at least 14 days' notice via email or a site notice. By continuing to use the Service after the changes take effect, you accept the new version.
